Health, Safety & Site Access

The customer acknowledges that restoration works may involve industrial equipment, chemicals, moisture control systems, and restricted work zones. For safety reasons, customers, occupants, children, and pets must not enter the working area where Elite technicians are actively working or where equipment, hoses, cords, or containment barriers are placed.

  • Do not touch or operate Elite equipment, tools, or containment barriers.
  • Be mindful of trip hazards from cords, hoses, and equipment placement.
  • Floors and surfaces may be wet, slippery, or uneven during and after works.
  • Where required, equipment (including air movers, dehumidifiers, heaters, negative air machines) must remain powered on and running unless Elite authorises shutdown.
  • Customers must inform Elite of any known hazards before work begins (including but not limited to asbestos, structural instability, electrical faults, contamination, vermin, unsafe flooring, or restricted access areas).

Elite reserves the right to pause or cease works if safe working conditions cannot be maintained.

Scope of Restoration Services

Elite Restoration and Maintenance applies industry-approved methods, equipment, and procedures with due care and professionalism. Restoration services are performed on a best-effort basis to mitigate further damage and improve outcomes; however, the customer acknowledges that Elite cannot guarantee full return to pre-loss condition.

Results vary depending on material type, duration of exposure, contamination level, and prior condition. Certain damage may be irreversible, including swelling, delamination, corrosion, staining, warping, odour absorption, and microbial penetration. No guarantee is given that all items can be restored or salvaged.

Pre-Existing & Hidden Conditions

Elite is not liable for pre-existing, concealed, or progressive conditions that are not visible or detectable during initial inspection. These may include, but are not limited to:

  • Long-term moisture intrusion, pre-existing mould growth, or underlying building defects
  • Structural rot, weakened substrates, or corrosion
  • Non-compliant building materials or installations
  • Asbestos-containing materials or other hazardous materials

Such conditions may only become apparent after removal of materials, drying, cleaning, or other restoration activities commence.

Fire Damage Restoration

Fire and smoke restoration outcomes depend on soot type, extent of heat exposure, ventilation pathways, and material porosity. The customer acknowledges that:

  • Smoke odours, staining, and corrosion may persist despite treatment.
  • Heat may weaken materials beyond visible damage.
  • Appliances or electrical items affected by smoke or heat are restored at customer or insurer risk unless replacement is authorised.

Elite does not guarantee complete odour elimination where materials are heavily penetrated or where odours are embedded in building cavities or contents.

Water Damage Restoration

Restoration work can only proceed once the source of leaking or flooding has ceased, been isolated, or otherwise made safe for restoration activities. Pricing and duration are dependent on drying progress and site conditions.

  • Equipment hire and monitoring may be charged per day until drying targets are achieved.
  • Additional days and/or equipment may be required depending on moisture readings, material composition, and ambient conditions.
  • Elite is not responsible for delays caused by restricted access, power outages, customer interference, or inability to maintain required conditions.

Mould Remediation

Mould remediation is undertaken using recognised remediation principles and is dependent on addressing the underlying moisture source. The customer acknowledges that mould is often linked to ongoing moisture issues beyond Elite’s control.

  • Complete mould eradication cannot be guaranteed unless moisture sources are corrected and re-wetting is prevented.
  • Any warranties or re-attendance conditions (if provided in writing) are subject to maintaining indoor humidity below 60% and preventing re-wetting.
  • Elite is not liable for mould recurrence caused by leaks, condensation, poor ventilation, building defects, environmental factors, or occupant behaviour.

Biohazard & Contamination

For sewage, biohazard, trauma, or contamination-related works, Elite’s services are limited to cleaning, decontamination, and disposal as quoted. Structural replacement or repairs are excluded unless separately authorised.

To the maximum extent permitted by law, Elite is not responsible for loss of use, indirect losses, or consequential damages arising from contamination events.

Quotes, Estimates & Variations

All restoration quotes and estimates are based on visible conditions and the information available at the time. The customer acknowledges that restoration scopes can change as hidden damage is discovered during works.

  • Additional works require approval from the customer and/or insurer (where applicable).
  • If works are declined after commencement, Elite may charge for work completed, call-outs, and equipment time already incurred.

Insurance Claims

Where works relate to an insurance claim, Elite acts as a restoration contractor and is not the insurer. Elite does not determine coverage, authorise claim payments, or control insurer timeframes.

  • Approval delays, coverage disputes, claim denials, or insurer payment delays are not Elite’s responsibility.
  • The customer remains liable for payment where an insurer declines, reduces, or delays payment, or where works fall outside coverage.

Access, Utilities & Responsibilities

Customers must provide and maintain reasonable access and operating conditions for restoration works, including:

  • Safe access to the property and work areas
  • Electricity for restoration equipment
  • Clear and safe workspaces free of hazards where reasonably practicable
  • Timely communication regarding changes, concerns, or restrictions

Failure to meet these requirements may delay works and/or incur additional charges.

Cancellation & Suspension

Elite reserves the right to charge a cancellation or suspension fee where sufficient notice is not given, access is denied, safety conditions are compromised, customer instructions prevent reasonable completion, or payment obligations are not met.

Minimum cancellation fees may apply depending on booking type, crew allocation, and equipment scheduling.

Payment Terms

The default payment term is Cash on Delivery (C.O.D.) unless otherwise agreed in writing. Insurance excesses, gaps, and non-covered items remain payable by the customer.

A late payment surcharge may apply to overdue invoices. In case of non-payment, Elite may engage a debt collector and associated costs will be borne by the customer, to the extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, Elite’s liability is limited to the value of the services provided. Elite is not liable for indirect, incidental, or consequential loss, including loss of profit, loss of use, or additional living expenses.

No warranty is provided beyond what is expressly stated in writing, and restoration outcomes may vary due to factors outside Elite’s control.

Acceptance of Terms

By authorising Elite Restoration and Maintenance to proceed, the customer acknowledges they have read, understood, and accepted these Terms and Conditions.
